A court in Dongguan, PR China announced an important decision to prevent increasing technology thefts and illegal production and sales of machineries. Donghua Machinery Ltd., Dongguan Cosmos Machinery Co. Ltd. and Dongguan Welltec Machinery Ltd., have been found guilty of unlawfully using confidential internal documents concerning the manufacture of PE pipe extrusion lines that are the property of Battenfeld China.
The Chinese competitors have been ordered to destroy immediately all illegal copies of drawings and other technical information and all copied PE pipe extrusion equipment manufactured on the basis of such documents still in production or already in the market. Production, sale and marketing of such products have now been prohibited, and a fine has also been imposed. According to the court, the infringement of Battenfeld China's intellectual property rights extends to the production of extruders and extrusion dies as well as downstream equipment such as vacuum tanks, hauls-offs and saws.
For more than 10 years, Battenfeld Extrusion Systems Ltd. has ranked among the technological leaders in China. At its production facility in Shunde, the subsidiary of Battenfeld Extrusionstechnik, Bad Oeynhausen, Germany manufactures turnkey pipe, profile and film extrusion lines with German know-how. It has also been making PE and PP pipe extrusion lines since 1998. In September 2003, Battenfeld China had filed a suit before Chinese court for product piracy against these three Chinese competitors, which are all members of the Cosmos Group.
